OrthoMetiQ provides specialized technical support services in the field of digital preoperative implant and prosthesis planning. The offering does not constitute medical, dental, therapeutic, or any other activity requiring professional licensure, approval, or authorization.

The services are not provided by licensed physicians, but are based on many years of practical experience in digital preoperative planning acquired since 2007, as well as professional involvement in projects within the environment of established companies in the orthopedic medical planning and implant industry.

No medical license, specialist medical qualification, or other professional qualification of a regulated healthcare profession is held or claimed in connection with this offering.

No Substitute for Medical Assessment and Decision-Making

All plans, template overlays, evaluations, reports, size or position suggestions, and other documents created via OrthoMetiQ serve exclusively as specialized technical support and as a basis for professional decision-making.

They do not replace independent medical assessment, clinical examination, indication, therapeutic decision-making, surgical planning in the medical sense, intraoperative verification, or final implant selection by the treating physician or the responsible medical institution.

Final responsibility for every patient-related medical assessment, every surgical decision, and the specific selection, sizing, positioning, and implementation of an implant remains exclusively with the treating physicians and/or the responsible medical institution.

No Promise of Healing, No Guarantee of Success or Implementation

Digital preoperative planning is a specialized planning aid; however, according to the current state of science and practical application, it is not associated with absolute predictive certainty. Deviations between preoperative planning and intraoperative or clinical reality may result in particular from patient-specific anatomy, image quality, projection and positioning conditions, calibration deviations, incomplete or inaccurate source data, implant-specific characteristics, software- or data-related tolerances, and intraoperative findings.

A 100% match with, or feasibility of, the planning is expressly neither owed nor guaranteed. This applies in particular, but not exclusively, to implant size, implant position, axis relationships, offset, leg length, resection level, fit, intraoperative feasibility, and medical, surgical, or economic outcomes.

The only service owed is the careful specialized technical processing of the data provided by the client within the agreed scope of services, to the best of available knowledge, practical experience, and a traceable methodological approach. No specific medical, surgical, therapeutic, economic, or clinical outcome is owed.

Data and Cooperation Responsibilities of the Client

The validity and reliability of any planning depend significantly on the quality, completeness, calibratability, and usability of the provided image and accompanying data. The respective client or transmitting party is solely responsible for the substantive accuracy, completeness, lawful transmission, and data-protection-compliant provision of such data.

Where patient-related data are transmitted, the client must ensure in advance that all legal requirements for processing and transmission are fulfilled. Where possible and legally required, data must be anonymized or pseudonymized before transmission.

Liability

The content and services of OrthoMetiQ are created with the greatest possible care. However, liability for the substantive, medical, or surgical usability of the created documents in a specific individual case is assumed only within the limits of mandatory statutory provisions.

To the extent permitted by law, the service provider’s liability for damages — irrespective of the legal basis — is excluded in cases of ordinary negligence, unless damages arise from injury to life, body, or health, or from the breach of material contractual obligations. In the event of a breach of material contractual obligations, liability for ordinary negligence is limited to the foreseeable damage typical for the contract. Liability for intent, gross negligence, and under mandatory statutory provisions remains unaffected.

External Use of Documents

Documents created by OrthoMetiQ may only be used within the scope of their intended professional purpose. Any isolated use, use detached from the overall context, modification, or transfer into other systems is carried out solely at the own risk of the respective user or client.
